By accessing or using the Site, purchasing products, downloading digital content, or participating in events or communities we host, you agree to these Terms. If you do not agree, do not use the Site.
1) Eligibility & Account
You must be at least 13. If you are under 18, you represent you have parental permission. You’re responsible for your account credentials and all activity under your account. Notify us immediately of any unauthorized use.
2) Store; Orders; Pricing
We sell books, merchandise, tickets, and digital products (e.g., eBooks, audiobooks, PDFs, downloads).
Prices, taxes, shipping, and promotions may change without notice. We may refuse or cancel orders (e.g., suspected fraud).
You authorize us and our payment processor to charge your selected payment method.
3) Shipping, Returns & Refunds
Physical goods: We generally ship within [X–Y] business days. Risk of loss transfers upon delivery to the carrier.
Returns not accepted 
Digital goods (eBooks, audiobooks, downloads): All sales are final once delivered or access is granted. If you have a file/access issue, contact us within 7 days.
Event tickets/workshops: Refunds per the event page. If we cancel, you’ll receive a full refund of the ticket price.
4) License to Use Site & Digital Content
Site: We grant you a limited, revocable, non-transferable license to access and use the Site for personal, non-commercial purposes.
Digital content (e.g., eBooks/audiobooks): Personal, non-transferable license; you may not share, resell, post publicly, or circumvent any technical protections.
5) Intellectual Property
All content on the Site—including text, artwork, images, logos, audio, video, and code—is owned by the Company or our licensors and protected by law. Except as explicitly permitted, you may not copy, modify, distribute, or create derivative works.
6) User Content; Reviews
If you post or submit content (reviews, comments, messages), you grant us a worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute that content for Site, marketing, and operational purposes. You represent you have rights to your submissions and they do not violate any law or rights of others.
7) Community Rules (Applies to blog, forums, and social channels we host)
No illegal, harassing, hateful, infringing, or pornographic content; no doxxing, spam, self-promotion without permission, malware, or attempts to disrupt the Site. We may moderate or remove content and suspend accounts at our discretion.
8) Prohibited Uses
You agree not to:

Use bots, crawlers, or any automated means not explicitly allowed.

Upload viruses, malicious code, or do anything that interferes with Site operation.

Infringe intellectual property or privacy rights.

10) Promotions, Preorders & Gifts

Special terms may apply to promotions, giveaways, preorders, and gift cards; see the specific offer page. Where there is a conflict, those terms control.

11) Communications & Marketing

By providing your email/SMS and opting in, you consent to receive messages from us. You can unsubscribe at any time (instructions in each message). Standard carrier/data rates may apply for SMS.

12) Privacy

13) DMCA / Copyright Complaints

If you believe content on the Site infringes your copyright, send a notice to our designated agent:

General: The Site and all content/products are provided “AS IS” and “AS AVAILABLE.” To the fullest extent permitted by law, we disclaim all warranties (express, implied, statutory), including merchantability, fitness for a particular purpose, and non-infringement.

Creative/educational content: Any writing prompts, courses, or advice are informational only and not professional, legal, medical, or therapeutic advice.

15) Limitation of Liability

To the maximum extent permitted by law, the Company and our officers, directors, employees, agents, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill, arising from or related to your use of the Site or products—even if advised of the possibility. Our aggregate liability shall not exceed the greater of: (i) $100 or (ii) the amount you paid to us in the 3 months preceding the claim.

16) Indemnification

You agree to defend, indemnify, and hold harmless the Company and our affiliates from any claims, losses, liabilities, damages, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Site/products, your content, or your violation of these Terms.

17) Governing Law; Dispute Resolution

Governing law: State of Texas, USA, without regard to conflict-of-laws rules.

Informal resolution: Contact us first to try to resolve any dispute.

Arbitration: Except for small-claims or injunctive relief, disputes will be resolved by binding arbitration administered by JAMS (or a comparable provider) in [Tyler, Texas] under its rules. Class actions and jury trials are waived.

30-day opt-out: You may opt out of arbitration within 30 days of first accepting these Terms by emailing legal@amandawoodruffbooks.com
 with your name and the statement “I opt out of arbitration.”

18) Changes to Terms

We may update these Terms at any time. Changes are effective when posted on the Site with an updated Effective Date. Your continued use after changes means you accept the revised Terms.

19) Termination

We may suspend or terminate access to the Site at any time, with or without cause or notice. Sections that by their nature should survive will survive (e.g., IP, disclaimers, limitations, indemnity, dispute resolution).

20) Miscellaneous

If any provision is found unenforceable, it will be modified to the minimum extent necessary or severed, and the rest remains in effect.

These Terms constitute the entire agreement between you and us regarding the Site and supersede prior agreements.

You may not assign these Terms without our consent; we may assign them as part of a merger, acquisition, or asset transfer.
